The Department of Justice has filed a rare motion to dismiss former Trump adviser Steve Bannon’s contempt of Congress conviction.
The conviction was tied to his defiance of a January 6 select committee subpoena.
Bannon has a petition pending before the Supreme Court, but the new motion seeks to scrap the conviction outright.
He had previously served a four-month prison sentence after his 2022 conviction.
US Attorney Jeanine Pirro wrote in court filings that dismissing the case is “in the interests of justice.”
DOJ officials argue the original subpoena stemmed from an improperly impaneled committee.
