The lawsuit, filed in 2024 in federal court, also claims he was forced to witness Megan Thee Stallion perform a sexual act on another woman in an SUV. According to court documents, Emilio Garcia believes Megan Thee Stallion intentionally engaged in the sexual encounter in front of him because she viewed his sexual orientation as making him “non-threatening.” He claims she would not have done the same in the presence of a heterosexual man. Emilio Garcia also alleges that Megan Thee Stallion made mocking comments about his appearance and tried to hit him with a remote control. The court found these allegations serious enough to warrant full litigation.

“Plaintiff has plausibly pleaded that he experienced the alleged inferior conditions of his employment on account of his sexual orientation… This is not an unreasonable inference to draw from the alleged facts,” wrote U.S. District Judge Gregory H. Woods in his July 2 ruling. But the alleged Ibiza incident was just the beginning. Emilio Garcia claims that after reporting the sexual encounter, Megan Thee Stallion‘s team retaliated by cutting his hours, docking his salary, and firing him. He further alleges that Megan Thee Stallion and her management harmed his professional career in the entertainment industry.

Judge Gregory H. Woods also sided with Emilio Garcia on the retaliation front: “These facts raise a reasonable inference that material terms and conditions of plaintiff’s employment were altered in retaliation for speaking up about the Ibiza incident.”

We give God the glory & he’s only just begun.”, Nicki Minaj posted on her Instagram account. The post came just hours after a federal judge ruled that Megan Thee Stallion must face allegations of sexual harassment and retaliation in court. The Grammy-winning rapper, backed by her Roc Nation management team, categorically denied all allegations, labeling Emilio Garcia a “con artist.” In public statements, her representatives insisted that the lawsuit “has no basis in fact or law” and expressed confidence that it will be dismissed if it proceeds to trial.
