State deputy Douglas Garcia (without a party), from the São Paulo Legislative Assembly, was ordered by the 45th São Paulo Civil Court to pay R$ 20,000 for moral damages to a woman mentioned in a dossier that listed alleged antifascists and listed them terrorist acts.
In the sentence, handed down on Thursday (06), Judge Guilherme Ferreira da Cruz wrote that the elaboration of dossiers is not part of the exercise of the mandate of state deputy and unduly launched charges of crimes against several people, without the existence of evidence.
“These conducts, notably the preparation of dossiers, are not related to the normal and regular exercise of the legislative mandate, whose holder must show himself to society (especially those who elected him) prudent and balanced, after all, mere suspicions in his mouth, due to the credibility that his position grants him, especially within the international community, they take on almost absolute truth”, wrote judge Guilherme Ferreira da Cruz.
The dossier was reportedly released by Douglas Garcia. There is still appeal to the decision, which is of first instance. Douglas Garcia is also the target of the fake news inquiry, conducted by the STF (Supreme Federal Court).
