In this Special Report, Senior Advocate Mukul Rohatgi analyses the Supreme Court’s verdict on the 2020 Delhi Riots conspiracy case delivered today. While Mr. Rohatgi terms the judgment denying bail to Umar Khalid and Sharjeel Imam as ‘balanced’ based on prima facie evidence of their ‘central role’, he strongly criticises the judicial delay. Highlighting that the trial has not commenced even after five years of incarceration with over 800 witnesses to be examined, he calls it a ‘blot on the judicial system’. The former Attorney General also discusses the court’s provision allowing the accused to re-apply for bail after one year if the trial does not progress, stating he wished the window was ‘six months instead of one year’.
