Phoenix attorney Roy Herrera said U.S. citizens are not legally required to answer questions about their immigration status during ICE operations, though he warned noncompliance could still lead to arrests.

The former federal prosecutor noted that while U.S. Immigration and Customs Enforcement has broad authority, agents can still face state prosecution for crimes such as trespassing or assault.

Herrera emphasized that many of these legal boundaries will ultimately be tested and defined in court.
