Full hearing: Ex-special counsel Jack Smith testifies to Senate Judiciary

In testimony before the Senate Judiciary Committee, former special counsel Jack Smith, who secured two indictments against President Donald Trump, told senators he continues to stand by his decision to prosecute the president. Smith said his team “developed proof beyond a reasonable doubt that President Trump engaged in serious crimes against our nation.” In his opening statement, Smith emphasized that he is “not a politician” and has no “partisan loyalty.” “If asked whether to prosecute a former president today based on the same facts, I would do so regardless of whether that President was a Republican or a Democrat,” Smith said.
“I will not be silenced by the continued threats of prosecution from the president or others,” he added.
Smith was questioned about accessing basic phone records from lawmakers around the January 6, 2021, Capitol attack, with one Republican senator, John Kennedy, telling him bluntly: “You make me want to throw up in my mouth.” Smith has confirmed that his special counsel’s office sought records of members of Congress’ call logs — a lawful effort typical of federal criminal investigations, but criticized by members.
