Time is running out for California employers to take action. If you own a business in California and even have one W-2 employee, the state now requires you to have a retirement plan in place.
The deadline for the California state mandate is looming for business owners and many may not be aware that it’s coming. By the end of December, every business in California must offer a retirement plan or face fines. Retirement Expert and Head of Gusto 401(k) Kevin Busque joins our Laura Cavanaugh to break down key deadlines and what business owners need to now before it’s too late.
The mandate is known as CalSavers. California law requires employers who do not offer a qualified retirement plan to provide their employees access to the state-sponsored CalSavers program. This applies to every business in California. California employers with as few as one W-2 employee are legally required to offer a retirement savings option by the end of the year. Business owners can enroll their employees in the state-run CalSavers IRA program or enroll in a qualified private retirement plan, like a 401(k).
The final registration deadline for employees with one to four employees is December 31, 2025. Deadlines for larger employers have already passed. Non-compliant businesses may face penalties.
Employers who fail to comply with the CalSavers mandate may face significant penalties, which begin with $250 per eligible employee after 90 days of non-compliance. That fine increases to an extra $500 per employee after 180 days after the initial notice from the state.
Unfortunately, a large number of small business owners are unaware of the CalSavers mandate and don’t know they could face fines if they miss the year-end deadline.
